Parsons Behle & Latimer’s real estate litigation practice attorneys have significant experience litigating all of the many issues that affect real estate and its development, including real estate purchase contracts, mechanic’s liens, foreclosures, boundary disputes, construction disputes, HOA litigation, land use and zoning, easements, wrongful liens, condemnations (takings claims and inverse condemnation claims), partitions, fraudulent transfers, lender liability claims and landlord/tenant disputes. Our attorneys have successfully handled these matters in state and federal courts at both the trial and appellate level.

Four B Props., LLC v. Nature Conservancy, No. 25-8024, 2026 WL 1018353 (10th Cir. Apr. 15, 2026)

Successful defense of multi-million dollar claims for promissory estoppel at summary judgment and on appeal before the U.S. Court of Appeals for the Tenth Circuit. The U.S. District Court for the District of Wyoming held that that the record evidence failed to establish any of the elements of promissory estoppel and that the landowner plaintiff was not entitled to relief in equity. The Tenth Circuit affirmed on appeal, upholding the binding terms of the perpetual conservation easement limiting plaintiff’s use of his property.  

Represented Shelter WF in Pro-Housing Zoning Matter in MT Supreme Court

Represented Shelter WF, a 501(c)(4), dedicated to pro-housing policy in Montana. Shelter WF intervened to defend Montana legislation for pro-housing zoning reforms, threatened to be undone by Montanans Against Irresponsible Densification. After prevailing in district court, Shelter WF and Parsons appealed to the MT Supreme Court to correct some errors, which the MT Supreme Court affirmed in their entirety.
